How are they getting away with it.
Aren't they already under investigation?

Probably adopting a sh-te or bust policy, get deducted 10 points but in the meantime spend what they like and stay up! I have no idea how they have spent so much on so many players and yet we do the opposite and yet we have an owner who has loadsa money.

Firstly, when the rolling 3-year losses are submitted in June this year, the loss that Forest made in 2020-21 will no longer count against them. Secondly, the sum they are allowed to lose over three years increases by £22M this season due to their being a P.L. club - as opposed to a Championship club in 2020-21. Thirdly, they, like us, sold a player last August (Brennan Johnson) for close to £50M - money that will show on this season's balance sheet.

Now, it may be that Forest's loss last season was so great that, even with an additional £70M plus to offset it, they cannot stay within their 3-year limit this time around, in which case they would surely be punished for willfully increasing a loss they already know to be in excess of the maximum permitted. That Forest are spending a modest sum suggests they believe they have a bit of wriggle room - possibly dependent upon the sale of Mangala.
